As of the date of this writing (10/19/2021), Delta 8 THC is permitted under Michigan state law. All hemp derivatives, cannabinoids, and isomers, including all tetrahydrocannabinols other than Delta 9 THC, are now legal in Michigan, in accordance with federal law.

(i) “Industrial hemp” means the plant Cannabis sativa L. and any part of that plant, including the viable seeds of that plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis. Industrial hemp includes industrial hemp commodities and products and topical or ingestible animal and consumer products derived from the plant Cannabis sativa L. with a delta-9-tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis.

(v) “THC” means tetrahydrocannabinol.

(4) “Marihuana” means all parts of the plant Cannabis sativa L., growing or not; the seeds of that plant; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant or its seeds or resin. Marihuana does not include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks, except the resin extracted from those stalks, fiber, oil, or cake, or any sterilized seed of the plant that is incapable of germination. Marihuana does not include industrial hemp.

(ii) /\6 cis or trans tetrahydrocannabinol, and their optical isomers.

(iii) /\3,4, cis or trans tetrahydrocannabinol, and their optical isomers.

Michigan's Cannabis Policy

You're in luck because marijuana is already legal in Michigan! Following Proposal 1 in November 2018 with a 55.9% yes vote, Michigan became the 10th state and the first in the Midwest to formally legalize marijuana.

Cannabis is legal to own and consume in the home by any adult who is at least 21 years old. The use of it in public areas such as parks and streets is still prohibited. The quantity of cannabis that one may carry is also limited. The amount of cannabis you can carry on your person in public is 2.5 ounces, and the amount you can carry within your home is 10 ounces.

Is Delta 8 Available in Michigan?

Yes, of course! With the passage of the 2018 Farm Bill, Michigan changed its hemp policy to conform to federal law, as did many other states. To do this, Michigan legislators formally defined hemp as a cannabis plant with a dry weight Delta 9 content of no more than 0.3%. Anything that is higher than that is regarded as marijuana. Cannabis is still a Schedule l substance and is still banned on the federal level, even though it is legal in Michigan.
