Delta 8 THC is a special cannabinoid that naturally occurs in hemp plants and is fast gaining popularity across the country due to its potential for both medical and recreational uses. Although Delta 8 THC shares certain characteristics with Delta 9 THC, the psychoactive ingredient in marijuana, it has entirely different effects and is typically less potent.

Yes, Delta 8 THC Is Legal In New Hampshire

According to state law in New Hampshire, Delta 8 THC is acceptable as of today, September 20, 2021. All hemp derivatives, cannabinoids, and isomers, including all tetrahydrocannabinols other than Delta 9 THC, are now legal in New Hampshire, in accordance with federal law.

New Hampshire's Policy Towards Cannabis

Regrettably, New Hampshire lags behind other states in its cannabis legislation. This is because its neighbors have legalized marijuana for adults but have kept the prohibition in place, similar to Rhode Island's and Idaho's limits on Delta 8 THC. The governor and the Senate have made it clear that they do not yet support the legalization and regulation of cannabis commerce.

Advocates were campaigning for HB 1648 earlier this year, a bill that would have allowed adults over 21 to simply possess and grow small amounts of marijuana at home lawfully. It is comparable to Vermont's legalization statute. Given that Vermont also allows the use of Delta 8 THC, it appears that New Hampshire is following in some of Vermont's footsteps. Despite the fact that House Resolution 1648 was approved by the house on February 20 by a vote of 236 to 112, Senate leaders have used the coronavirus pandemic as an excuse to postpone voting on this legalization measure.

We urge you to speak up to your state and local officials about your objections to legalization.

Read the laws for yourself.
